Idaho has been one of the fastest-growing states in the country for more than a decade, attracting both retirees and active families from higher-tax, higher-regulation jurisdictions. The state combines a favorable tax environment, a streamlined regulatory climate, and modernized statutes governing business formation, trusts, and real estate. At the same time, Idaho’s position as a community property state and its strong protection of private property rights mean that Idaho-specific knowledge is essential for any meaningful legal planning.

Idaho Estate Planning

Revocable living trusts, pour-over wills, durable powers of attorney, advance health care directives, special needs trusts, gun trusts, and probate and trust administration under Idaho Code Title 15 (Uniform Probate Code) and Title 68 (trusts). Idaho has no state estate tax and no state inheritance tax, making it an unusually favorable jurisdiction for legacy planning. For relocating families, we frequently re-paper trusts originally drafted in California, Washington, or other higher-tax states to take full advantage of Idaho law.

Idaho Real Estate

Residential and commercial real estate transactions, purchase agreements, leases, easements, water rights (a uniquely critical issue in Idaho real estate), rural land transactions, construction contracts, and real estate development. Idaho follows the prior appropriation doctrine for water rights (“first in time, first in right”) — an essential factor in any agricultural, ranching, or rural residential transaction.

Idaho Business Law

LLC and corporation formation under Idaho Code Title 30, operating and shareholder agreements, S-Corporation tax elections, partnership and joint venture agreements, contract drafting, non-compete and non-solicit agreements (under Idaho’s recently revised statutory framework), acquisitions, and franchise representation. Idaho’s business-friendly environment and minimal franchise tax requirements make it a popular state for both small business formation and out-of-state companies expanding into the region.
