What Sets Idaho Apart

Idaho is a community-property state for marital property (Idaho Code § 32-906), one of nine in the United States. That alone changes the analysis on divorce, estate planning, and even how spouses hold title to real property. Idaho also has no state estate or inheritance tax, recognizes transfer-on-death deeds for real property (I.C. §§ 15-15-101 to 15-15-114), and applies a robust homestead exemption (I.C. § 55-1003). For real estate, Idaho follows the prior-appropriation doctrine for water rights (I.C. Title 42), which has no analog east of the Rockies and is often the most valuable feature of an agricultural or recreational parcel. Idaho business law allows series LLCs (I.C. § 30-25-1201 et seq.) and reasonable, time-limited non-competes (I.C. § 44-2701 et seq.).
